But if you buy this property without doing a forensic check of the paperwork, you might be walking into a legal nightmare.

Here is the truth that standard estate agents often glaze over: In the Algarve, what you see is not always what is legal.



The "Flexible" Truth of Real Estate Listings


In Portugal, selling agents are hired by the seller to get the highest price. They often market a property based on its physical reality, not its legal reality.

  • That "4th bedroom"? It might be a storage room on the plans.

  • That "guest annex"? It might be registered as a garage or agricultural support building.

  • That sparkling pool? It might have been dug without a permit from the Câmara (Town Hall).


Why Does This Matter?


You might think, "Who cares? The building is there!" But buying a property with illegal structures can have serious consequences:

  1. Fines & Demolition: The Council can force you to demolish the illegal parts or pay heavy fines.
